Colombia's Supreme Court sparks controversy for using AI to dismiss cases, but the ruling is also accused of being "written by AI"

The Supreme Court of Colombia is facing a wave of criticism after rejecting an appeal on the grounds that the document “shows signs of being AI-generated.” The agency stated it used the Winston AI tool and concluded that only 7% of the content was written by humans, thus declaring it invalid.

However, lawyer Emmanuel Alessio Velasquez uploaded the court’s decision AP760/2026 along with the software and received the opposite result: 93% of the content was assessed as AI-generated. Other independent tests also showed conflicting results, raising questions about the reliability of AI detection tools.

Colombian lawyers warn that relying on opaque algorithms could violate the right to access justice. Meanwhile, the internal guidelines issued in 2024 by Colombia’s judiciary prohibit judges from using AI to make judicial decisions.
