The Trump administration plans to make the FTC chairman responsible for the new Department of Justice anti-fraud division

Odaily Planet Daily reports that, according to informed sources, officials in the Trump administration are considering appointing Federal Trade Commission (FTC) Chair Andrew Ferguson to lead the newly established Department responsible for combating nationwide fraud. Ferguson will continue to serve as FTC Chair. Vice President Pence stated last week that the department will be overseen by the White House, “with nationwide jurisdiction over fraud issues.” Pence also mentioned that the Department will create a new Assistant Attorney General position responsible for leading related fraud investigations. This structure will blur the traditional boundaries between the presidency and the Department of Justice, which currently has several divisions dedicated to criminal and civil fraud investigations. The law also explicitly prohibits commissioners from “engaging in any other business, profession, or employment.” It is currently unclear whether this regulation will affect Ferguson’s concurrent holding of the new position.
